Our Mission & Mandate
Standing against institutional decline, demanding uncompromising integrity
The Anti-Corruption Initiative operates as an independent public watchdog for the European legal space. We are completely unattached to political parties, governmental subsidies, or corporate interests. Our sole allegiance is to the democratic rule of law, the fundamental rights of the European Union, and the public interest.
This initiative was founded because we refuse to stand idly by while democratic institutions, public trust in the rule of law, and the foundational principles of good European administration (Art. 41 CFR) deteriorate. We need principled, upright politicians and civil servants, alongside strictly regulated, transparent procedures to halt any harmful influence on the lives of citizens. Every suspicious proceeding belongs in the public spotlight – what alone counts is uncompromising adherence to constitutional standards and the defense of the public good.
Origins & Foundation: From a Documented Real-World Case to Systemic Institutional Oversight
How a documented encounter with administrative obstruction demonstrated the acute necessity of systemic investigation
A thoroughly documented real-world case of bureaucratic stonewalling, denial of basic information, and suppression of formal records marked a fundamental, irreversible breach of civic trust in the integrity of public institutions: although the citizen acted throughout the entire proceeding strictly solution-oriented, cooperatively, and in true alignment with the statutory purpose of the process, the public apparatus responded with falsehoods, internal gag orders, arrogant silence, and collusive institutional shielding all the way to the top of the ministry. When a public administration responds to a straightforward, privately underwritten civic application by refusing every constructive compromise and trampling on basic civic rights – how do public authorities behave behind closed doors when handling multi-million-euro procurements, consulting fees, studies, and discretionary subsidies?
Out of this profound breach of trust, the Initiative Against Corruption was founded: not as a personal grievance forum, but as an institutionalized, methodical response to administrative opacity and abuse of power. It serves as an unyielding watchdog for the constitutional state:
1. Prior Administrative Guidance & Lawful Preparation:In preparation for a two-week family visit, a citizen residing abroad sought formal guidance from the competent ministry and a state police directorate. The authorities concurrently advised that, since standard domestic declarations of commitment (EVE) require domestic residence, a declaration of liability accompanied by proof of liquidity and bank statements constitutes the proper and standard submission. To confer additional weight upon the document, the citizen executed this declaration of liability under oath.
2. Filing & Comprehensive Financial Underwriting:The application was submitted meticulously: the citizen assumed full financial liability backed by over €75,000 in liquid assets on European bank accounts. The applicant independently demonstrated over €4,000 in personal savings for the 16-day stay (nearly €300 per day with accommodation fully provided by family). Paid return flight tickets, employer confirmation, and formal leave approvals were fully documented. The total financial coverage exceeded €80,000.
3. Formulaic Rejection & Embassy Stonewalling:The diplomatic mission summarily rejected the application using boilerplate phrasing: „Financial means insufficient“. Between the request for amendment and the final decree, the applicant contacted the post three times in writing and twice by telephone to resolve the obvious discrepancy. The authority stonewalled completely, refused to clarify, and issued the identical boilerplate refusal.
4. Ministerial Intervention & The Futile Escalation Ladder of Reason:Only after escalating to the supervisory ministry did the mission suddenly assert that third-party liability was „legally impossible“. A senior ministerial department head subsequently executed a sudden 180-degree reversal: shielding the mission, he asserted the alleged impossibility to the citizen – in direct contradiction to the threefold prior guidance issued by his own ministry.
What followed was the natural path of any citizen acting in good faith and trusting in common sense: when faced with obstruction at one level, one turns to the next higher authority in the reasonable hope of finding accountability. Yet the entire ministerial hierarchy stonewalled: the competent Head of Section did not even deem it necessary to reply. The Secretary General circularized the issue, claiming the subordinate director would handle it. And the Foreign Minister personally, when formally addressed with the matter, simply looked away and refused to intervene.
Even an earnest mediation effort through members of the governing political party appointing the Foreign Minister hit a bureaucratic brick wall: while individual party figures privately described the administrative proceedings as „completely absurd“ and attempted to mediate, their efforts were coldly rebuffed by the ministry itself.
Through this persistent silence, deliberate non-intervention, and passive toleration, senior officials and the Foreign Minister made it unmistakably clear that they considered this procedural attrition to be entirely legitimate—both legally and humanly.
Formal disciplinary and supervisory complaints lodged against the officials involved proved entirely futile and yielded no remedy or investigation: the department head who had executed the 180-degree reversal to shield the mission was subsequently removed from his post—evidently to take him out of the line of fire and away from the flashpoint; yet rather than facing disciplinary scrutiny, he was promoted to an even higher executive position.
5. Cross-Verification with 13 Diplomatic Missions:The citizen cross-checked this legal assertion with 13 other diplomatic missions of the same state worldwide, unmistakably submitting the exact same factual circumstances. All 13 authorities independently and in writing confirmed established administrative practice: a declaration of liability with bank statements is entirely standard, lawful, and routinely accepted.
6. Cover-up, Gag Directive & Visa Poisoning:Rather than correcting the mistake, the ministry asserted that all 13 missions had misunderstood the simple facts. To consolidate the obstruction, the ministry issued an internal directive („Maulkorb“) prohibiting diplomatic missions from providing the citizen with guidance or governing benchmarks (such as daily subsistence rates) for future applications.
Simultaneously, a negative flag was placed in the European visa registry to poison any subsequent filing. Ever since, the citizen has been denied any substantive guidance whatsoever, and every attempt to submit a new application has been systematically sabotaged.
7. Collusive Protection by Oversight and Prosecutorial Bodies:Preliminary mediation and supervisory mechanisms failed just as comprehensively: an appeal to the European SOLVIT network, housed within the country's Ministry of Economy, evaporated without effect—instead of providing independent mediation, officials simply coordinated with the Foreign Ministry and rubber-stamped its defensive stance. A further supervisory authority dismissed the complaint after a single-day pro-forma review, denying any procedural impropriety after clearing the official party line internally.
When subsequently submitted to the parliamentary ombudsman board, the oversight body likewise shielded the ministry: it accused the citizen of „setting a trap“ for the ministry by cross-checking official advice with other missions. The assigned caseworker of the ombudsman board went so far as to bluntly assert to the citizen that they had had no right whatsoever to contact the 13 other diplomatic missions—an authoritarian denial of rights that perverts peaceful civic inquiries to public authorities into an illicit act. The ombudsman board further defended the administrative opacity, asserting that benchmarks such as daily subsistence rates need only be disclosed after formal filing – and went so far as to claim that neither the diplomatic mission nor the ministry is under any legal obligation whatsoever to provide general guidance on what typically constitutes suitable proof for a successful application.
Later, the ministry admitted to the ombudsman that the 13 missions had indeed answered correctly – yet continued to deny any remedy or guidance for new filings.
The institutional nadir was ultimately marked by criminal justice: A formal criminal complaint for abuse of office (§ 302 StGB) was dismissed by public prosecutors without initiating investigative proceedings or inspecting internal files—under the formulaic pretext that there was „no initial suspicion“. Given the documented gravity of the misconduct, 13 written confirmations from other embassies, demonstrable internal gag directives, and ministerial admissions of error, this refusal abandons all standards of due diligence: The issue was not even an immediate indictment, but the baseline statutory obligation to secure evidence. Crucially, because no legal remedy to an independent court exists against the prosecution's refusal to find an initial suspicion, the prosecutor's office acted as an insurmountable firewall: By aborting the case at the threshold, the justice system deliberately prevented any independent judge from ever ruling on this entire questionable complex, the internal directives, and the extent of official discretionary abuse.
8. Shifting Pretexts in Court & Over 300 Days of Ongoing Attrition:Before the administrative court, the authority continuously introduced new pretexts (alleging bank accounts within the EU internal market were unsuitable; asserting generic suspicions of lack of willingness to return despite confirmed permanent employment; furthermore, the personal relationship was suddenly called into question, even though this had never once been raised during the entire prior administrative proceeding and could have been conclusively proven at any time through extensive photographic and video documentation). Even the country's highest-circulation daily newspaper ("Kronen Zeitung") investigated the case, formally requested a statement from the ministry, and confronted officials with the procedural discrepancies—yet received zero response.
When pressed repeatedly as to why the authorities refused to participate in a constructive, amicable solution, the ministry retreated behind the circular pretext of the pending court proceedings. This exposes the calculated bad-faith attrition: While the citizen acted entirely solution-oriented and in true alignment with the statutory purpose from day one, actively addressing every purported concern with concrete safeguards (such as placing €10,000 into a locked escrow savings bond or offering a registered partnership), the authority completely stonewalled any constructive resolution. Compromise solutions offered by the citizen were disregarded. A routine family visit to an 82-year-old grandmother is currently being deliberately obstructed for over 300 days and counting—the court proceedings remain pending, and a judicial ruling is still outstanding. Yet even a judicial decision changes virtually nothing about the lack of procedural protection:
Crucially and perfidiously, this legal reality produces a devastating structural effect: Because a visa proceeding procedurally pertains only to a specific, time-limited travel period, the statutory binding effect of judicial decisions does not extend to subsequent applications. Even when an administrative court rules after months of litigation that a visa refusal was unlawful, that judgment carries no automatic res judicata effect for future travels—because the travel period originally applied for has long since expired. For every new journey, the applicant must start the entire process from scratch. Precisely herein lies the cynical calculation of the ministry: The pending court proceeding merely serves the apparatus as a fig leaf to play for time and endlessly obstruct the same applicant on every subsequent filing using newly manufactured pretexts. This creates a perpetual cycle of administrative arbitrariness and litigation, effectively gutting constitutional legal protection and trapping the applicant in an endless cycle of what are often years-long court proceedings.
It is self-evident that such an escalation is categorically and procedurally impossible under any premise of bona fide administrative conduct: when a citizen acts from the very outset completely transparently, cooperatively, and with comprehensive private financial underwriting while repeatedly proposing constructive solutions, a total procedural blockade persisting for over 300 days defies all objective justification. That the bureaucratic apparatus actively prevented any amicable resolution—despite all material prerequisites being satisfied and multiple safeguards offered—exposes deeply questionable, improper motives: administrative discretion was not exercised for conscientious statutory enforcement, but perverted into an instrument of harassment and attrition. Such conduct directly violates the constitutional doctrine of proportionality and conclusively proves that the authority was never engaged in a proportionate assessment of the merits, but in the ruthless demonstration of institutional power and the collusive cover-up of official malpractice.
Forensic Assessment:Because formal written filings do not vanish within established filing registries and 13 independent diplomatic missions of the same state confirmed official administrative practice in writing, innocent oversight or a genuine administrative mistake is empirically ruled out. This documented case reveals a cohesive system of bureaucratic arbitrariness, grave abuse of authority, and organized attrition:
1. Breach of Legitimate Expectations, Ministerial Stonewalling & Condonation from Above (Phases 1 & 4):Disregarding the threefold official prior guidance (breach of the statutory duty of administrative guidance under § 13a AVG) and the supervisory department head's abrupt 180-degree reversal demonstrate that ministerial bodies collusively shield subordinate errors rather than restoring legal compliance. That formal supervisory complaints evaporated without consequence and the department head who orchestrated the deceit to shield the mission was taken out of the line of fire and rewarded with a promotion to a higher executive tier demonstrates entrenched institutional esprit de corps: malpractice cover-up is not sanctioned within the apparatus, but rewarded with career advancement.
That the entire ministerial chain of command—from Section Chief and Secretary General up to the Foreign Minister personally—responded with silence, circular deflection, or complete indifference, and coldly blocked even mediation attempts by party members who recognized the case as „completely absurd“, proves the total failure of supervisory oversight: senior leadership tacitly condoned the arbitrary obstruction, de facto sanctioning it as both legally and humanly legitimate.
2. Evident Disproportionality & Administrative Overreach (Phase 2):Dismissing total financial coverage exceeding €80,000 for a 16-day family visit (a mathematical daily rate of €5,000) as „insufficient funds“ defies common sense and directly violates the constitutional doctrine of proportionality.
3. Willful Denial of Due Process & Boilerplate Pretexts (Phase 3):Repeatedly ignoring three substantive written clarifications and issuing boilerplate refusal decrees violate the fundamental right to be heard (§ 45 Abs. 3 AVG) and the statutory duty to provide specific individualized reasoning (§ 60 AVG).
4. Breach of Equal Treatment & Proof of Arbitrariness (Phase 5):Written confirmation of standard practice by 13 independent diplomatic missions provides conclusive proof of arbitrary discrimination and unjustified divergence from uniform administrative standards (Art. 7 B-VG).
5. Intentional Procedural Sabotage & Abuse of Authority (Phase 6):The internal ministerial gag order withholding objective benchmarks (such as subsistence thresholds) and the preemptive poisoning of the European visa registry constitute calculated bad faith designed to obstruct future applications.
6. Systemic Institutional Failure & Inverted Accountability (Phase 7):When mediation bodies such as SOLVIT and supervisory authorities dismiss grievances following single-day pro-forma reviews, collusively align their legal positions with the target ministry, and parliamentary ombudsmen accuse citizens of „setting traps“, deny citizens any right to inquire with other public posts, and assert that the state is not even obligated to inform applicants about suitable proof of success, while public prosecutors dismiss criminal complaints for abuse of office (§ 302 StGB) through an unappealable denial of initial suspicion without any evidentiary inquiry, thereby suffocating any judicial review of administrative discretionary abuse in the cradle, institutional checks and balances collapse entirely.
7. Shifting Pretexts in Court, Infinite Blockades & Fundamental Rights Deprivation (Phase 8):Continually manufacturing new pretexts before the court, disregarding less intrusive means (such as locked bank bonds), and orchestrating over 300 days of ongoing bad-faith attrition with a court ruling still outstanding to deliberately obstruct a family reunion (violating the constitutionally guaranteed right to respect for family life under Art. 8 ECHR) expose the citizen's structural defenselessness: While the citizen acted strictly solution-oriented and in true alignment with the statutory purpose at all times, the authority perverted the administrative process into a weapon of attrition.
That the ministry stonewalled even formal press inquiries from the leading daily newspaper ("Kronen Zeitung") and instead entrenches itself behind a court proceeding that, due to the lack of res judicata extension over future filings, evaporates into legal irrelevance for subsequent applications, provides definitive proof of calculated bad faith: the administrative apparatus neutralizes judicial review through a perpetual procedural blockade. Where bureaucratic arbitrariness reigns and judicial oversight evaporates into the void for future filings, citizens enjoy zero equality of arms without public pressure.
It is precisely out of this immense breach of trust that the resolute mission of our initiative was born: where the state destroys civic trust through institutional stonewalling, concealment, and procedural attrition, systematic transparency investigations under European access to documents standards (Art. 42 CFR) are indispensable to restore democratic transparency and equality of arms.
Cooperation on Equal Terms: For Proportionate Action & The Duty of Good Faith
Article 41 EU Charter of Fundamental Rights & The Principle of Proportionality as Pillars of Constitutional Governance
When bureaucratic procedures are instrumentalized to fend off legitimate civic requests through procedural attrition, the foundational purpose of public service is betrayed. The right to good administration under Article 41 of the EU Charter of Fundamental Rights guarantees every citizen impartial, fair, and timely handling of their affairs, alongside the fundamental right to be heard and to reasoned decisions. A mature constitutional democracy engages with its citizens as equals in constructive cooperation on eye level.
We vigorously advocate for the principle of proportionate administrative action: public authorities are bound by the European prohibition of excessive measures (Übermaßverbot) and must invariably choose the least burdensome, citizen-enabling means available. Administrative procedures must never be perverted into tools of administrative harassment or attrition. We insist that public authorities fulfill their statutory mandate to enable citizen rights with uncompromised integrity, seriousness, and transparency.
